Decisions under these Acts, Rules and Regulations rest with me in my statutory capacity, subject to certain rights of appeal to the High Court. I also have certain statutory functions under the Copyright and Related Rights Act, 2000 largely concerned with dispute resolution, copyright licensing schemes and with registration of licensing bodies. In addition, my Office makes information available on Industrial and Intellectual Property. The Intellectual Property Unit of the Department of Enterprise, Trade and Employment has responsibility for intellectual property policy and preparation of legislation in this field. My Office furnishes advice in these matters to the Department, including comments on the impact on its work of proposed legal or regulatory changes. In my report, unless the context otherwise indicates, a reference to the 1963 Act means the Trade Marks Act, 1963, to the 1964 Act means the Patents Act, 1964, to the 1992 Act the Patents Act, 1992, to the 1996 Act the Trade Marks Act, 1996 and a reference to the 2001 Act means the Industrial Designs Act, During 2008 the Office focussed on implementing our three year Strategy Statement with a view to continuing to improve efficiency and our service to our customers. It is worth pointing out that in 1997, prior to decentralisation of the Office, there were 88 staff working in the Office. At the 31 st December 2008 the staff complement was 54.3 full time equivalents. This reduction in staff is due mainly to the innovation of staff and management in the Office and to their willingness to initiate and embrace change in work practices and technology. The significant achievements during the year included: - The implementation of a new database system for the Office s administration systems, to provide improved performance and capacity. The closing of the Dublin information centre, which saved the exchequer 250K. A new system was implemented to facilitate online payment of patent grant fees and trade mark and design registration fees. All statutory forms were reviewed and redesigned with a view to electronic filing. To mark World Intellectual Property Day the Office held an Open Day and an art and essay competition for schools to raise awareness of innovation and the benefits of protecting IP. In 2009 the Office will conduct a major review of its business processes and we aim to expand our online services and our use of electronic communications with our customers. Eamonn Laird Ceannasaí Arna dhátú 29ú Bealtaine Eighty First Annual Report of the Controller of Patents, Designs and Trade Marks GENERAL The Patents Office is responsible for the grant and registration of patent, trade mark and design rights in Ireland. These rights play a key role in fostering innovation and competitiveness and are governed by a complex framework of national and international law. Through the provision and administration of these rights, the Office assists Irish business, industry and individual entrepreneurs to optimise the economic potential of their intellectual property. In December 2007, the Office produced a new Statement of Strategy for the period 2008 to The aim of this strategy, which is delivered through annual business plans, is to facilitate an environment in Ireland where individuals are able to achieve their rights and entitlements under the various pieces of IP legislation to the greatest extent possible and according to their needs. The following commentary and accompanying statistical report considers the activities of the Office during 2008 in the context of the 6 main objectives in the strategy statement, which are seen as central to the operational efficiency of the Office. Objective (1) To grant and maintain patents, to register and maintain trademarks and designs and to carry out the statutory functions under the Copyright legislation, transparently and accountably, based on international best practice. There were some variations in business volumes during The number of patent applications increased by 9% to 1007 applications. This is the first time the Office has received more than 1000 patent applications since the year Applications for the registration of industrial designs, which had seen a steady decline since 2003 with the availability of a Community Design registration, increased by 47% on However, applications for Supplementary Protection Certificates decreased by 46%, applications for national trade marks decreased by 11% and there was a drop of almost 15% in the number of applications for international trade mark registrations designating Ireland which were received during the year. Notwithstanding these variations, the tables below show a marked stability in the levels of national applications for patents, industrial designs and trademarks since The fluctuations in business volumes may, to an extent, reflect some of the global economic turmoil and the uncertainty which began to affect business in Ireland and elsewhere during More detailed information can be found in the Business Statstics Section of the report. The Plan sets out a series of customer service targets against which performance is monitored during the year. The level of performance against specific customer service targets achieved during 2008 is reported on in some detail later in this report. Performance was generally satisfactory overall; in many cases the targets set were met fully.
